Terms and Conditions
These Terms and Conditions ("The Rules") shall apply to the Product being run by Rim Rock Enterprises Limited ("Company"), the Tournament Points Program (“Program”), and the rewards and Prizes that will be given out.
The Company reserves the right to modify these Rules at any time without notice, so it is important that you check them periodically. Your continued use of the Website (www.kick360.com) and participation in the Program is considered acceptance of these Rules, and any modified terms included therein.
Definitions:- The following words and terms, when used with this agreement, shall have the following meanings:
a. “Game Points” – Game Points are points accumulated by participating in the various Flash Games that are available in the Website. The Game Points that are accumulated through these flash games will vary for each game. Kindly refer to each game’s page to see how Game Points may be collected.
b. “Redemption Points” – Redeemed Points are earned when you play or purchase with any of the third party companies who directly advertise with Kick360.
c. “Bet Points” – Bet Points are earned by placing bets using either Game Points, Bet Points or Redemption Points on the different matches available in Kick360’s virtual betting service. Odds and prices for Kick 360’s virtual betting service are available, kindly refer to the page to see specific odds and prices for each sporting event.
TOURNAMENT POINTS PROGRAM
1. ACCUMULATION OF POINTS
1.1 Once you have registered and created a new account, you are already entitled to earn Points of different types (Game, Redemption and Bet) when you undertake various online activities on the Website, as set forth below.
1.2 The activities that will allow you to earn Points and the number of points earned per activity is subject to change from time to time without notice, at the Company’s sole discretion. As such, you are encouraged to regularly check the Website for any updated on these activities , the Points and these Rules.
1.3 Currently, you can earn Points in any of the following activities:
a) Game Points – by playing the various Flash Games that are available on the Website and each Flash Game will have a different method of rewarding the user with Game Points. Each Flash Game will have an equivalent amount of Game Points that can be redeemed based on the score that you get on each game. Scores are automatically converted into Game Points and credited to your account.
b) Redemption Points – by participating in different promotions set by www.kick360.com and other sites that directly advertise with Kick360, players may be able to earn Redemption Points. These Redemption Points may be used to bet in Kick360’s virtual betting
c) Bet Points - You can earn even more Points by using either your Game or Redemption Points that you have already accumulated and start betting for your favourite teams in our virtual betting and pool betting services.
1.4 Posting of Points
Game Points and Bet points will be posted on a real time basis. The Company shall automatically be converting Game and Bet Points you earn through any of the manners provided above.
i) Game Points will automatically be posted to your account after each game you play. Game scores will automatically be converted into Game points based on each game’s conversion method as stated in each game’s page.
ii) Bet Points will be added and deducted to/from your account automatically on a real-time basis.
• Entering the your stake and confirming the placement of your bet will automatically deduct your stake from your total points
• Once a match is finished, the results will be automatically updated and corresponding points will be automatically added into your account
• Pool Betting results will also be updated automatically as soon as all the matches on the betting slip are done.
iii) On the other hand, Redemption Points accumulated from 12AM (GMT +8) of Friday to 11:59PM (GMT +8) of Thursday (7 Days) will be posted to your account on a weekly basis. When such points are earned however; these are posted to your account at 3PM (GMT +8) on the following Friday and every last day of the month. Note: Redemption Points will only be accumulated by participating in third party companies who directly and indirectly advertise with Kick360.
1.5 The Company reserves the right to suspend, terminate, revalue or modify without notice to you, all or part of the Points Program value structure and offers. The Company reserves the right to adjudicate all Points discrepancies at its sole discretion, and you agree to abide with the decision of any adjudication, which shall be final and binding on you.
1.6 All points shall be reset after each month except for points earned in Fantasy Football.
1.7 The Company takes reasonable care to ensure that your Points are accurately deposited in your account. However, you are responsible for ensuring that Points are correctly reflected and you should notify the Company within twenty four (24) hours from posting if Points have not been correctly posted to your account. The Company shall not be liable for any losses suffered due to any errors in the posting of points.
1.8 Points may only be used in conjunction with the prize redemption and for betting services on site to accumulate more points. Points cannot be redeemed for cash.
1.9 All Points are personal to you and are non-transferable. They are not considered to be property, and as such, you cannot sell, transfer or assign your Points to any other person.
2. PRIZES FOR REDEMPTION
2.1 Various prizes are available for redemption at the Kick360 Online Redemption Center.
2.2 Prizes and items can only be redeemed using points earned from the aforementioned procedures.
2.3 Prizes will vary depending on the item’s availability.
2.4 Points can only be redeemed for prizes and items, and are not convertible to cash.
2.5 The Company reserves the right to substitute the prizes provided herein at its absolute discretion.
2.6 Each player is only allowed to redeem a maximum of 2 prizes every month
3. DELIVERY OF PURCHASED ITEMS
3.1 Items purchased through the site’s online store will require personal information from the users.(e.g. Full Name, Complete Mailing Address, and any proof of address that the Company may require)
3.2 The registered mailing address will be the primary basis for delivery of prizes. The Company reserves the right to demand for a valid secondary mailing address should the primary address be invalid.
3.3 The Company reserves the right to concede to any and all country’s importation rules, regulations, and laws.
3.4 Items purchased through the online store may be subject to duties, taxes, and laws as speculated by each country’s government. Any import duties and taxes that may be due on the items in your country will be for your account.The Company is not responsible for any additional costs set forth by each country’s Law on any and all duties and taxes with regard to importation of any and all items.
3.6 The User is responsible for completing any necessary requirements from his side and should complete any of such requirements within thirty (30) days unless otherwise stated by the governing law. At the same time, the User is responsible in
informing the Company upon completion of requirements.

3.7 The Company is not liable for any delays in the delivery of items.
3.8 The Company is not liable for any damages or losses suffered in the delivery of items. The Company reserves the right to renounce any form of warranty for any and all items.
3.9 The Company is not responsible for granting and honouring any form of warranty.
3.10 The Company reserves the right to void any form of warranty.
3.11 The Company reserves the right to reject any form of refund.
3.12 The Company reserves the right to all items and prize discrepancies at its sole discretion, and you agree to abide with the decision of any adjudication, which shall be final and binding on you.
4 BETTING AND ELIGIBILITY
4.1 Betting is open only to individuals who are at least eighteen (18) years of age or the age of consent or majority in your jurisdiction. .
4.2 Various Matches from different sports will be available for betting through the Virtual Betting page or Pool Betting page.
4.3 Placing of bets is open once the scheduled fixtures have been posted. Placing of bets closes one (1) hour before the start of a scheduled match.
4.4 A bet is considered placed once the bet slip is confirmed. Once a bet is confirmed, points are automatically deducted from the user’s account and respective points are updated.
4.5 Cancellation or changing of placed bets is not allowed.
4.6 Only accumulated points can be used to bet. Likewise, only points can be redeemed for winning on the bet placed.
4.7 Bet points are placed into players’ accounts once the fixture/match that you bet on has been updated with its respective result.
5. PUBLICITY
5.1 If you have won or have accomplished an honourable achievement, the Company has the right to use your account details in any publicity. The Company will only use your username, likeness, home town, biographical information and the fact that you have won a prize for any lawful purpose, such as but not limited to website announcements and promotional materials.
6. MISCELLANEOUS
6.1 Subject To Local Laws. Although no money is wagered on Kick360 and therefore games played at Kick360 are not considered gambling by most entities, you are subject to the laws of the country, state, city or other legal entity (collectively "Jurisdiction") in which you reside and/or from which you access the Website. Access to the Website may not be legal for some or all residents of, or persons present in, certain Jurisdictions. It is your responsibility to determine the law that applies in the applicable Jurisdiction, and the Company does not make any representation or warranty, express or implied, as to the lawfulness of your participation in the program, or that materials on this Site are appropriate for use in your Jurisdiction. Kick360 does not intend that the Website be used for winning prizes by persons present in Jurisdictions in which registration or bonding of the contests is required. Kick360 does not intend that the Website be used by persons present in Jurisdictions in which placing bets on sports events for free may be prohibited or restricted. You agree that the Website does not constitute an offer, solicitation or invitation by the Company for the use of any service in any Jurisdiction in which such activities are prohibited or restricted. You agree that, and the Company asserts that, it shall not have any responsibility under any laws in any Jurisdiction. The Company further reserves the right to require you to provide proof that you are eligible to participate and win prizes prior to payment of any winnings or prizes. The Company also reserves the right, in its sole and absolute discretion, to refuse service and access to any potential participant.
6.2 Continuing Duty and Affirmation. Each time you use the Website, you represent and warrant that:
(i) you are at least eighteen (18) years of age, or the legal age to use this Website in the applicable Jurisdiction, whichever is higher;
(ii) your access to the Site, your participation in Kick 360’s offering are legal in your applicable Jurisdiction;
(iii) the e-mail address submitted by you is owned or controlled by you; and
(iv) all information you provide is true, accurate, current and complete. All such representations and warranties are relied upon by the Company. By applying for registration, you authorize us make any and all enquiries which in our sole discretion, we consider necessary to verify the information provided by you. We may require you to submit such proof of age, identity and place of residence as we may require, at any time. We reserve the right to suspend and/or terminate your registration and/or account where it has grounds to suspect that any of your provided information is untrue, inaccurate, not current or incomplete. You maintain the responsibility to promptly update the information provided at registration to keep it true, accurate and complete.
6.3 If the Company determines that operating Kick360 no longer feasible for any reason, including, but not limited to, a change in the risk of operating the contests, or insufficient participation in the contests, then the program may be ended we shall owe you nothing.
6.4 These Rules constitute the entire agreement between you and the Company regarding the Website and shall be in supplement to the Terms and Conditions of the Website and other policies that may be found therein.
6.5 Language Discrepancies. In case of any discrepancy between the meanings of any translated versions of this Agreement, the English language version shall supersede.
6.6 These Rules shall be governed by and construed in accordance with English law.
6.7 The parties irrevocably agree to submit to the exclusive jurisdiction of the English Courts in relation to any claim or matter arising under or in connection with these Rules.
6.8 The Company is not responsible for any marketing activities and promotions conducted by other parties
7. Privacy and Security
7.1 By registering an account with us, you accept that we keep the personal information that you have provided and that we may disclose some of this information to third party companies for mailing/delivery procedures and promotions.
7.2 All necessary information provided to us by the user will be kept confidential by the Company and will only be provided to third party companies who will be used to deliver ordered items from Kick360 and partner sites who directly advertise Kick360.
7.3 The Company reserves the right to execute analyses of user's behaviour and characteristics to gain data and information on user’s activity within various sections of the site. Data may be provided to third party companies.
7.4 The Company takes reasonable care in keeping the users’ provided information safe and confidential. All information is transferred using encryption technologies and once stored on our servers, it is maintained safe using the latest Firewall technologies available today.
